Rules
I.
GENERAL DESCRIPTION
TSC
Productions LLC, the producer ("Producer") of a DVD series featuring
home and professional videos, seeks submission by members of the
public of their home or professional videos showing stunts, crashes,
tricks and/or unique events for possible inclusion in the DVD TSC
series or broadcast on a television network. Only videos conforming
to TSC Productions LLC Standards and Practices will be eligible for
inclusion in the DVD TSC series or television programs, based on
Producer’s judgment.
The number
of DVD’s and television shows and prize awards is yet to be determined
but will be announced prior on the TSC official website. For each DVD,
there will be a first, second and third prize awarded for best videos.
II.
PROCEDURES
1.
Persons wishing to enter should send as many different videos as they
wish to TSC Productions, P.O. Box 225, Santa Monica, CA 90405. Tapes
will be reviewed on an ongoing basis. See section VIII for information
on deadlines.
2.
Entrants should include their return address and telephone number and
a brief written description of the clips being submitted.
3.
All
submissions shall become the sole property of Producer. Producers
WILL NOT return any tapes, please make the appropriate copies.
Producer
reserves the right to destroy all videos for which return was not
requested at the time of submission. Producer is not responsible for
lost damaged or misdirected tapes under any circumstances. Please keep
a copy of your submission.
4.
Film/ video formats that are acceptable (VHS, digital video, Beta SP).
Videos transferred to DVD or CD-ROM will be accepted for initial
screening and review, however the original tape must be provided to
Producer upon request in order to meet eligibility and TSC
requirements. If not so provided, the submitted video will not be
eligible for inclusion in the program.
5.
Videos should be in the sports genre of action sports.
6.
Producer reserves the right to edit and/or alter any submission.
7.
Videos need not be exclusive to TSC Productions LLC.
8.
Decisions of the judges as to all contest matters are final and
nonappealable. All submissions are subject to the terms of these rules
and all entrants agree to be bound by these rules and the decisions of
the judges. Producer reserves the right to amend these rules at any
time.
III.
ELIGIBILITY
1.
Employees of TSC Productions and their parent, subsidiary, and
affiliated companies and anyone involved in the production;
administration or judging of the contest, as well as immediate
family/same household members of anyone so employed or engaged are
not eligible for prize awards.
2.
Persons under 18 may enter but written parental consent will be
required before their entries will be considered.
3.
Entrants whose clips are chosen for inclusion in a program must sign a
Release and Indemnity in the form presented attesting, among other
things, to the fact that they are the rightful owners of the submitted
clips and that the clip may be submitted and broadcast without
obtaining permission from or making any payment to any third party.
All persons appearing in the clips must sign consent forms and/or
releases before the submission can be eligible for prize awards.
Parent or guardian must sign the consent/release form for minors.
Failure to provide requested releases and/or consents will result in
disqualification of entrant. These release and/or consent forms will
be provided by the Producer. Notwithstanding the foregoing, the
submission of videotape constitutes the submitter's permission to use
the videotape in and in connection with the program and all
exploitations thereof, including, without limitation, advertising and
promotion and, further, constitutes the submitter's representation
that all necessary consents and permissions therefor have been
obtained.
4.
Each submission must be solely the original work of entrant or
licensor of the submission.
5.
Each entrant represents that his/her submission does not infringe on
any third party's copyrighted material, trademark or other
intellectual property rights.
6. By
submitting your videotape each entrant agrees to release, discharge,
and hold harmless TSC Productions LLC, the respective parent,
subsidiary and affiliated companies, licensees, and assigns, and their
respective officers, directors, employees, agents and representatives
from any claim or liability arising from or related to submission of
the entry, participation in this contest, appearance in the DVD series
or on the program, and/or acceptance or use of any prize.
7.
Each entrant agrees that his/her submission shall be governed by and
construed under and in accordance with the laws of the State of
California applicable to contracts entered into and wholly performed
therein. Each entrant consents and agrees to the exclusive
jurisdiction of the federal and state courts of the State of
California, located in the County of Los Angeles.
IV.
JUDGING CRITERIA
1.
Videos will be judged for inclusion in the DVD series and television
shows and for prizes on the basis of their crashes, stunts tricks
and/or uniqueness. Examples of videos that have been considered
include those showing successful stunts, unexpected crashes, difficult
tricks, crashes during sports or activities, bloopers during tricks,
events, competitions or natural phenomena. From time to time, the
Producer may request footage on specific topics, such as skiing or
skateboarding requests. Such submissions will be included with the
general submission pool for contest purposes and will compete with the
general submission pool for any prizes. All videos must conform to TSC
Productions LLC Standards and Practices policies.
2.
Producer will select clips for inclusion in each contestant show as
follows:
A. Each tape
will be assigned a number, logged in and entered into a computer.
B. All tapes
will then be screened and rated on a scale of 1 to 5. Any tape
rated below a 2 will be rejected for use as a contestant tape
on any show.
C. The
Producer's representatives will view tapes rated 3 and above
for possible inclusion in a particular DVD.
V.
CONTESTANT DVD (prizes)
1.
The voting procedure for the contestant DVD’s series will be as
follows, unless otherwise specified:

Of the
clips included in each DVD series or show, the Producer will select 3
finalists based on ability, visual effectiveness and/or uniqueness.
Producers
reserve the right to use alternate judging and/or voting procedures,
as determined by Producers, for any DVD series or television show or
segment including, without limitation, for any special DVD’s or shows.
VI.
PRIZE - DVD’s
1.
The contestant DVD’s will be divided into two or more blocks at
Producers' sole discretion. There will be first, second and third
place winners from each block. If the DVD is cancelled prior to the
completion of the contest in a block, Producers reserve the right not
to award a grand prize.

The voting procedure for the prize DVD’s will be as follows, unless
otherwise specified:

Producer(s) shall view and vote on the finalists.
OR
B. the public
will view and vote on the finalists via www.thrillsspillsandchills.com.
Videos will be shown without added voice-over or effects. The votes
from www.thrillsspillsandchills.com will be combined with the votes
from the Producers to determine the winners of the Prizes.
3.
The criteria for selecting the prize winners of each block will be
overall visual effectiveness, difficulty and/or uniqueness.
4. In the
event of a tie, the vote will be taken again, between the tying
entries, until the tie is broken.
5.
Producers reserve the right to change the voting procedures on any of
the DVD series.
VII.
PRIZES
1. For the
DVD’s, the first prize for each entry is a Dimension Snakeboard
($200.00 value). Second prize is K2 Pro Model Inline skates ($200.00
value) Third prize is a five (5) cases of Rockstar Energy Drink.
2. In the
event of a tie for the first prize, the vote will be taken again,
between the tying entries, until the tie is broken. In the event of a
tie for second place, we will follow the same procedure, event of a
tie for third place; both parties will receive Rockstar Energy Drink.
3.
Clips included in a previous DVD and/or broadcast are not eligible for
a first, second or third place prize in future DVD entries.
4.
Prizes will be awarded to the person(s) submitting the videotape,
provided they certify and establish to Producer's satisfaction that
they are the owner(s) of the videotape and further provided that they
have complied with the official rules and sign all necessary forms as
determined by Producer.
5.
Winners are solely responsible for all federal, state and local taxes.
VIII.
CONTEST DEADLINES
1.
The contest deadline dates for the 2005 - 2006 season is yet to be
determined, but will be announced on thrillsspillsandchills.com and in
advance of the deadline for submissions. Producer must receive all
tapes on or before the deadline dates to be eligible for inclusion.
At Producers'
sole option, any video may be retained and considered for use and
reuse, and used and reused, in any subsequent edition of the program,
or any other program or ancillary use in any media.
IX.
RELEASES
1.
All entrants must sign all consent forms; general releases and other
authorizations in the form provided by Producer or are eliminated from
consideration. Releases will include, among other things, a statement
that the videos are the exclusive property of the entrant(s) and that
the events purported to be spontaneous were in fact spontaneous and
not staged.
Releases must
be obtained from all identifiable persons depicted in videos. Parent
or guardian must sign the consent/release form for minors.
